Drug Manufacturing Defense in Victorville

Local Courtroom Experience for Victorville Drug Manufacturing Charges

California drug manufacturing allegations require a defense grounded in the precise conduct covered by Health and Safety Code § 11379.6. At Holistic Legal, we handle manufacturing and transporting allegations through our drug-crimes practice. These offenses are typically charged at the felony level. We examine what allegedly occurred, the evidence supporting the charge, and whether law enforcement obtained that evidence legally.

Attorney Parag P. Shah previously worked at the District Attorney’s office and brings experience from both sides of the courtroom to each case. Our firm has handled hundreds of criminal cases. That perspective informs our individualized approach to serious drug charges in Victorville.

What California Health & Safety Code § 11379.6 Prohibits

California Health and Safety Code § 11379.6 makes it a felony to manufacture, compound, convert, produce, derive, process, or prepare a controlled substance. The statute applies when the alleged activity involves chemical extraction or synthesis. A prosecutor must connect the evidence to prohibited conduct rather than rely only on the presence of equipment, materials, or a person at a particular location.

The process doesn’t have to be complete before the state files a charge. An early or intermediate preparation step can fall within the statute when the prosecution alleges it was part of an unlawful manufacturing process. The purpose of the activity, the defendant’s knowledge, and the role attributed to each person are therefore important subjects for investigation.

Offers to manufacture: Subdivision (e) separately addresses an offer to manufacture a controlled substance. An alleged offer can carry an imprisonment term of three, four, or five years. Because this provision concerns an offer rather than a completed process, the wording, context, and evidence of the alleged communication require careful review.

Penalties for Drug Manufacturing in Victorville

A conviction under Health and Safety Code § 11379.6 is generally punishable by three, five, or seven years in California state prison. The court may also impose a fine of up to $50,000. The sentence depends on the charged conduct, applicable enhancements, criminal history, court findings, and other case-specific circumstances.

Additional issues that may affect the consequences include:

  • Presence of a child: California law treats it as a factor in aggravation when a child younger than 16 resided at a location where methamphetamine manufacturing occurred, and a separate statute allows for an added prison term in certain cases.
  • Proximity to an occupied structure: California law treats it as a factor in aggravation when a methamphetamine manufacturing violation occurred within 200 feet of an occupied residence or another occupied structure where a person was present.
  • Immigration status: A manufacturing conviction may create serious immigration consequences for a non-citizen, including possible deportation.
  • Post-conviction relief: Expungement may be available after successful completion of probation when the person didn’t receive a state-prison sentence. A conviction followed by state-prison time can’t be expunged under that rule.

Sentencing enhancements aren’t automatic simply because the prosecution alleges them. Their application depends on whether the evidence satisfies the legal requirements. We review the base charge and each alleged enhancement separately when assessing potential exposure.

Defense Issues in a Drug Manufacturing Case

A sound defense begins with the evidence supporting each required element of the charge. We develop personalized legal strategies based on the alleged conduct, the source of the evidence, and our client’s circumstances. Depending on the case, we also evaluate whether alternative sentencing or a rehabilitation program may be available.

Unlawful Search & Seizure

Manufacturing prosecutions may rely on evidence obtained from a home, vehicle, building, electronic device, or other location. An unlawful search or seizure can become a significant defense issue. We may review the scope of a warrant, the facts used to obtain it, whether officers exceeded its authorization, and whether an exception to the warrant requirement applied.

Mere Presence

Being present where drug manufacturing allegedly occurred doesn’t by itself establish participation. The evidence must connect the accused person to conduct prohibited by Health and Safety Code § 11379.6. Ownership, access, communications, forensic evidence, and witness accounts may affect whether the prosecution can establish that connection.

Knowledge & Alleged Participation

Lack of knowledge that a substance or process was illegal can raise a defense issue, depending on the facts. The prosecution must support the alleged conduct and mental state rather than assume knowledge from proximity alone. We examine what our client knew, which actions the evidence attributes to that person, and whether the available facts support alternative explanations.
